Gathering information
The Service performs the functions of obtaining information about Users and their behavior in the following ways:
- by voluntarily entered information in the contact form,
- by saving cookie files (so-called “cookies”) in Users’ terminal devices.
The Service may also save information about connection parameters such as IP address, proxy server, session name, user devices, operating system, and browser, location, and the names of internet or mobile service providers for technical purposes related to server administration, to perform the contract to which the data subject is party (based on Art. 6 para. 1 lit. b of GDPR) as well as to generate aggregate and statistical information (e.g., about the region from which the connection is made), which cannot identify the User, as well as for security purposes.
Data processing
As part of the process of transferring data through a form aimed at carrying out the purchase process. The User receives information as referred to in Art. 13 para. 1 and 2 of the GDPR and gives consent to the collection and processing of personal data by the Controller in the manner and for the purposes described in the relevant consent clauses and this document. The User is responsible for providing false personal data. The Controller does not process Users’ personal data using automated decision-making tools, including profiling.
Purposes of data processing
The Controller processes personal data in order to contact the person interested in the services. Personal data processed for other purposes each time require the consent to be granted by active action of the User after being informed about the purpose, duration, and scope of processing. To fulfill a legally justified purpose, in particular direct marketing of own products or services, with respect for your rights and freedoms, the Controller may process data to the extent indicated in the form when submitting a query:
- for the period of correspondence initiated by a query sent by the User via the form – until its completion;
- for a period corresponding to the life cycle of cookies saved on the User’s devices – in the case of processing personal data of the User who only browses the content of the Service. The Controller also stores Users’ personal data when it is necessary to fulfill legal obligations incumbent on him, resolve disputes, enforce User obligations arising from concluded contracts, maintain security, and prevent fraud and abuse – until the expiry of the limitation period for claims against the User.
Scope of processed data
The processing of Users’ data takes place in the range of:
- conducting direct marketing (the scope of data is dependent on the information voluntarily provided by the User and data related to the User’s activity recorded and stored through cookies) – based on Art. 6 sec. 1 lit. f GDPR, i.e., due to the fact that processing is necessary for the purposes arising from legally justified interests pursued by the Controller or by a third party;
- sending commercial information by electronic means in accordance with Art. 10 sec. 2 of the Act on electronic services provision of July 18, 2002 (the scope of data which the User has voluntarily provided) – based on separately given consent;
- using telecommunications terminal equipment and automatic calling systems for direct marketing purposes in accordance with Art. 172 of the Act of July 16, 2004, Telecommunications Law (the scope of data which the User has voluntarily provided) – based on separately given consent;
- fulfilling legal obligations incumbent on the Controller in connection with the conduct of business activity (the scope of data which the User has voluntarily provided) – based on Art. 6 sec. 1 lit. c GDPR, i.e., due to the circumstance that processing is necessary to fulfill a legal obligation incumbent on the Controller.
Rights
Every User may request:
- access to their personal data,
- correction of personal data,
- restriction of processing of personal data,
- deletion of personal data,
- portability of personal data,
- to withdraw consent at any time, however, the withdrawal of consent shall not affect the lawfulness of processing based on consent before its withdrawal,
- to lodge a complaint with a supervisory authority, i.e., the President of the Office for Personal Data Protection.
Moreover, every user may object to the processing of personal data. To exercise the above rights, the user should contact the Controller by sending an email to: zmburzyk.office@o2.pl. The Controller fulfills the user’s request promptly within the scope provided by the relevant legal provisions. The removal, restriction, transfer, and objection to the processing of data will affect the provided services and may prevent the proper performance of these services. The Controller ensures that User data is processed exclusively for the purpose of contacting the person interested in the offer or for other purposes based on individually granted consents. The Controller considers the reported request promptly, no later than within 30 days from its receipt. However, if – due to the complex nature of the request or the number of requests – the Controller will not be able to consider the User’s request within the deadline, it will consider it within the next two months, informing the User in advance about the intended extension of the deadline. The Controller informs every recipient to whom the personal data have been disclosed about the correction or deletion of personal data or restriction of processing carried out in accordance with the User’s request, unless this proves impossible or involves a disproportionate effort.
Cooperating entities
Depending on the processes related to the type of service, the Controller may transfer data to entities necessary for the proper execution of the process. In the case of Customer service (inquiries and claims), the data is made available to entities providing support in the indicated range.
Entrusting processing
For the proper functioning of the website, it is necessary for the Controller to use the services of external entities. The Controller uses only the services of such processing entities that provide sufficient guarantees to implement appropriate technical and organizational measures so that the processing meets the requirements of the Regulation and protects the rights of the data subjects. The Controller entrusts the processing of personal data to the following entities: service providers supplying the Controller with technical, IT, and organizational solutions (in particular suppliers of computer software, electronic mail, and hosting) – The Controller provides the collected personal data of the User to the selected supplier acting on his behalf only to the extent necessary to achieve the given data processing purpose consistent with this privacy policy. All entities to which the Controller entrusts the processing of personal data guarantee the application of appropriate measures for the protection and security of personal data required by law. The Controller may be obliged to provide information collected by the Site to authorized bodies based on lawful requests to the extent resulting from the request.

- The Controller has the right to change this document, about which the User will be informed in a way that enables them to become familiar with the changes before they come into effect, e.g., by posting relevant information on the main page of the Service, and in the case of significant changes also by sending a notification to the email address provided by the User.
